The ability of an employer to terminate an employee is very misunderstood by most people. In Illinois most employment relationships are what we call “at will,”meaning either party can terminate the relationship at any time for any reason with or without notice beforehand.

A lot of employees who wind up being separated from their company on an involuntary basis believe that they have been improperly terminated if they weren’t given notice. That’s not necessarily the case.

However, it’s a fact sensitive situation and sometimes the actions of the employer, employee handbooks and other documents that have been given to the employee may create an actual employment agreement that can be enforced, and as a result the employee may receive compensation from an improper termination.
